Terms of Service
1. About ParklyNow
ParklyNow ("we", "us", "our") provides parking management software and an online booking platform at parklynow.com (the "Platform"). The Platform enables parking lot operators ("Lot Operators") to manage their operations, accept online reservations, process payments, and offer their services to customers ("you", "your") who search for, compare, and reserve parking spaces.
Software and technology provider. We are a technology company that builds and maintains the software tools used by Lot Operators to run their parking businesses online. We are not a parking provider and we do not own, operate, or manage any of the parking facilities listed on the Platform.
Lot Operator responsibilities. Each Lot Operator is an independent business solely responsible for obtaining and maintaining all licences, permits, insurance, tax registrations, and any other legal authorisations required to operate a parking facility in their jurisdiction. ParklyNow does not verify, guarantee, or assume liability for any Lot Operator's legal compliance, business practices, or fitness to operate.
Contract is with the Lot Operator. Each Lot Operator independently sets pricing and availability, determines facility rules and conditions, and provides any on-site services (including shuttle/transfer services where applicable). Your parking service contract is formed directly with the relevant Lot Operator, not with ParklyNow.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts to use our Platform. By creating an account or making a booking, you confirm that you meet this requirement. You are responsible for keeping your login credentials confidential and for all activity under your account.
3. Searching & Booking
Our Platform allows you to search for parking by entering a city or address, your dates and times, and a search radius. Results show available lots with live pricing calculated for your specific dates.
When you make a booking, you will be asked to provide your vehicle details — including license plate number, make/model, and colour. This information is shared with the Lot Operator so their staff can identify your vehicle at check-in.
A booking is confirmed once payment has been successfully processed. You will receive a confirmation email containing your booking details, the Lot Operator's address, shuttle/transfer information (where applicable), and check-in instructions.
All prices displayed on the Platform are in Euros (EUR) and include applicable taxes unless otherwise stated. The total price shown at the time of booking is the price you pay.
4. Payments (Collection on Behalf of Lot Operators)
Payments are processed securely through Stripe. We accept major credit and debit cards. Your payment information is transmitted directly to Stripe and is never stored on our servers.
Agency collection model. By making a payment, you authorise us to charge the specified amount and to collect funds on behalf of the relevant Lot Operator as their authorised agent for the limited purpose of facilitating your reservation. Payment is taken at the time of booking.
Settlement and fees. ParklyNow collects the booking amount and remits the Lot Operator's share after deducting applicable platform, payment processing, and transaction fees (our "Fees"). The Fees are agreed between ParklyNow and each Lot Operator and may vary by operator and/or booking type.
5. Receipts / Invoices and Taxes (Who Issues What)
Lot Operator receipt obligation. The Lot Operator is the supplier of the parking service and is solely responsible for issuing any customer receipt/invoice required by applicable law, including charging and reporting VAT (or equivalent taxes) based on the location of the parking facility and the Lot Operator's tax status.
ParklyNow does not issue the parking receipt. Your booking confirmation from ParklyNow is not a fiscal/tax receipt for the parking service. It is a reservation confirmation and proof of payment/booking for your convenience.
Fee invoicing. ParklyNow issues invoices/settlement statements to Lot Operators for our Fees (commission/platform/processing amounts) as applicable.
6. ParklyNow Wallet
Registered users have access to a ParklyNow Wallet, a closed-loop stored-value balance associated with your account ("Wallet Credit"). Wallet Credit can be used to pay for future bookings partially or in full. Wallet funds may be applied automatically at checkout when available.
How Wallet Credit is created. Wallet Credit may be credited in the following circumstances: refunds from booking modifications (where the new price is lower than the original), cancellation refunds (where approved), promotional credits, and manual top-ups via card payment.
Not cash / not transferable. Wallet Credit is not a bank account, is not cash, and cannot be withdrawn, transferred to other users, or exchanged for cash. Wallet Credit does not earn interest. Wallet Credit has no expiry date for as long as your account remains active. If your account is terminated for breach of these Terms, any remaining Wallet Credit may be forfeited to the extent permitted by law.
Wallet and receipts. Wallet Credit is a payment method for future bookings. No parking receipt/invoice is issued at the moment Wallet Credit is created (e.g., a refund to Wallet) because no new parking service is supplied at that time. The Lot Operator issues the parking receipt/invoice when a booking is made (regardless of whether you pay by card, Wallet, or a combination).
7. Booking Modifications
You may modify the dates and times of a confirmed booking from your customer dashboard, subject to the following conditions:
The new dates must have availability at the same parking lot and parking type. Each Lot Operator may set a modification cutoff — a number of hours before your check-in time after which modifications are no longer permitted. If no cutoff is set, modifications are allowed at any time before check-in.
If the modified booking results in a lower price, the difference is automatically credited to your ParklyNow Wallet. If the new dates result in a higher price, you will be charged the additional amount.
8. Cancellations & Refunds (Manual Support Process)
No self-service cancellation. To cancel a booking, you must contact us by email at support@parklynow.com. Cancellations are processed manually.
Operator policy controls eligibility. Refund eligibility and timing depend on the Lot Operator's cancellation policy and any cutoffs shown at the time of booking or communicated to you. Cancellations made after the operator's cutoff may not be eligible for a refund.
Default refund method: Wallet Credit (full value). If a cancellation/refund is approved, the default refund method is a credit to your ParklyNow Wallet for the refundable amount. This method is intended to preserve the full refundable value for you.
Optional card refund (fees deducted). If you request a refund back to your original card payment method, we can process it where technically possible. However, payment processing and transaction fees charged by Stripe and/or card networks are not refunded to us. Therefore, a card refund will be reduced by the non-refundable processing fees associated with the original payment. We will inform you of the applicable deduction before processing the card refund.
1) Booking price €100 (eligible refundable amount €100). Wallet refund: €100 Wallet Credit.
2) Same booking, card refund requested. If original processing fees were €3.20, card refund: €96.80 returned to card (fees deducted).
3) Partial refund: If operator policy allows 50% refund on late cancellation, refundable amount is €50. Wallet refund: €50 Wallet Credit (default) or card refund: €50 minus applicable non-refundable processing fees.
9. Consumer Information: No 14-Day Withdrawal for Date-Specific Parking
Parking reservations are for specific dates/times and capacity is reserved for you. Where applicable consumer law provides a right of withdrawal for distance contracts, this right generally does not apply to services related to leisure/transport/parking where the contract provides for a specific date or period of performance. Your cancellation/refund options are therefore governed by the Lot Operator's cancellation policy described above.
10. Promo Codes & Loyalty Rewards
Promo Codes: We may issue promotional discount codes from time to time. Promo codes are subject to individual terms (e.g. minimum spend, expiry date, one-time use). They cannot be combined with other offers unless explicitly stated. We reserve the right to revoke or modify promo codes at any time.
Loyalty Rewards: Registered users may be eligible for automatic discounts after a certain number of confirmed bookings. The loyalty programme details (e.g. "10% off every 5th booking") are displayed in your dashboard. Loyalty discounts are funded by ParklyNow, not by the Lot Operator. We may change or discontinue the loyalty programme at any time without notice.
11. Reviews
After you check out from a parking lot, you will receive an email inviting you to leave a review. Reviews are rated across five categories: cleanliness, ease of access, staff and service, security, and value for money. You may also leave a written comment.
By submitting a review, you grant ParklyNow a non-exclusive, royalty-free, perpetual licence to display, reproduce, and distribute your review on the Platform. Reviews must be honest, accurate, and based on your actual experience. We reserve the right to remove reviews that are abusive, fraudulent, contain personal information, or violate these Terms.
12. Chargebacks, Payment Disputes & Fraud
If you initiate a card chargeback or payment dispute with your bank/card issuer, we may request information from you and/or the Lot Operator to respond. Chargebacks can result in the cancellation of your reservation and/or restriction of account features if we reasonably believe there is misuse or fraud.
If a chargeback is decided against us and the funds are withdrawn, we may recover corresponding amounts (including chargeback fees) from any Wallet Credit and/or future refunds to the extent permitted by law.
13. Your Responsibilities
You agree to provide accurate and truthful information when creating your account, making bookings, and submitting vehicle details. You are responsible for arriving at the parking lot at the booked time with the vehicle matching the details you provided.
You must comply with all rules and instructions of the Lot Operator while using their facility, including speed limits, designated parking areas, and check-in/check-out procedures.
You must not use the Platform for any unlawful purpose, attempt to interfere with its operation, create multiple accounts to abuse promotions, or submit fraudulent bookings or reviews.
14. Limitation of Liability
ParklyNow acts as a booking intermediary and payment collection agent and is not responsible for the parking services provided by Lot Operators. This includes, but is not limited to: damage to or theft of your vehicle, personal injury on the Lot Operator's premises, failure of shuttle or transfer services, changes to the Lot Operator's facility or amenities, and any dispute between you and the Lot Operator.
While we take reasonable steps to verify Lot Operators and ensure information accuracy, we do not guarantee the completeness, accuracy, or reliability of any listing, pricing, review, or availability shown on the Platform.
To the maximum extent permitted by law, ParklyNow's total liability to you in connection with these Terms or your use of the Platform shall not exceed the amount of our Fees (commission/platform fee component) earned in connection with the specific booking giving rise to the claim.
15. Account Termination
You may delete your account at any time by contacting us at support@parklynow.com. Upon deletion, your booking history and personal data will be handled in accordance with our Privacy Policy below.
We may suspend or terminate your account without notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or abused the Platform in any way.
16. Changes to Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. For material changes, we will notify registered users by email.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Zagreb, Croatia.

Privacy Policy
This Privacy Policy explains how ParklyNow collects, uses, stores, and protects your personal data when you use our Platform.
1. Data Controller
The data controller is ParklyNow, operated from Zagreb, Croatia. For privacy-related enquiries, contact us at: support@parklynow.com
2. GDPR Roles: ParklyNow and Lot Operators
ParklyNow as Data Controller: We act as a data controller for account management, Platform security, customer communications, wallet administration, and maintaining payment/financial records.
ParklyNow as Data Processor: To facilitate bookings, we transmit booking data (including vehicle details) to the relevant Lot Operator. In doing so, ParklyNow acts as a processor for the limited purpose of transmitting and supporting the booking flow.
Lot Operators as independent Data Controllers: Lot Operators receive booking and vehicle details to deliver the parking service and are independent controllers for how they handle that data on-site and in their own systems. Lot Operators are responsible for providing their own privacy information where required by law.
3. Data We Collect
Account Information: When you create an account, we collect your first name, last name, email address, phone number, and password (stored in hashed form). You may optionally provide your billing address (street, city, state, postcode, country).
Booking Information: When you make a booking, we collect the dates and times of your stay, the selected parking lot and type, and the price paid. We also collect your vehicle details — license plate number, make/model, and colour — which are necessary for the Lot Operator to identify your vehicle.
Payment Information: Payment card details are processed and stored exclusively by Stripe, our third-party payment processor. We do not have access to your full card number, CVV, or expiry date. We receive only a transaction reference and confirmation of payment from Stripe.
Wallet Transactions: We store records of your wallet balance, top-ups, debits, and credits (including references such as booking modification refunds, cancellation refunds, and promotional credits).
Reviews: When you submit a review, we store your rating scores (across five categories), your written comment, and the date of submission. Reviews are displayed publicly on the Platform alongside your first name and last initial.
Technical Data: We automatically collect your IP address, browser type, device information, and pages visited when you use the Platform. This data is collected through standard server logs and may be used for security, analytics, and fraud prevention.
Location Data: With your permission (via your browser), we may access your approximate location to show nearby parking lots. You can deny or revoke location access at any time through your browser settings.
4. How We Use Your Data
We use your personal data for the following purposes:
To provide our services: processing bookings, calculating pricing, sending confirmation emails, managing your wallet balance, facilitating booking changes, and supporting check-in/check-out at parking lots.
To share with Lot Operators: when you make a booking, your name, email, phone, and vehicle details are shared with the relevant Lot Operator so they can provide the parking service. Lot Operators have their own privacy obligations and are responsible for data they receive from us.
To communicate with you: sending booking confirmations, modification confirmations, review requests after checkout, password reset emails, and occasional service-related notices.
To improve our Platform: analysing usage patterns, diagnosing technical issues, and improving the user experience.
To prevent fraud: monitoring for suspicious activity, duplicate accounts, abuse of promotions, and payment disputes.
To comply with legal obligations: responding to lawful requests from authorities and maintaining records as required by applicable law.
5. Legal Basis for Processing
Under the General Data Protection Regulation (GDPR), we process your data on the following bases:
Contractual necessity: processing your booking, managing your account, handling payments, administering the wallet, and providing customer support.
Legitimate interest: fraud prevention, platform security, analytics, service improvement, and defending legal claims.
Consent: location data access (browser geolocation) and optional marketing communications, where applicable. You may withdraw consent at any time.
Legal obligation: maintaining financial records and responding to lawful requests.
6. Data Sharing
We share your data with the following categories of recipients:
Lot Operators: your name, email, phone, vehicle details, and booking dates are shared with the Lot Operator whose facility you have booked.
Stripe: payment card data is transmitted directly to Stripe for processing. Stripe's privacy policy governs their handling of your payment data.
Hosting Provider: our Platform is hosted on servers located within the EU. Order and customer data is stored securely on our servers. The hosting provider may have access to server-level data as part of infrastructure management.
We do not sell your personal data to third parties. We do not share your data with advertisers or data brokers.
7. Data Retention
Account data: retained for as long as your account is active. If you request account deletion, we will delete or anonymise your personal data within 30 days, except where retention is required by law (e.g. financial records).
Booking records: retained for up to 5 years after the booking date for legal and accounting purposes.
Wallet transactions: retained for as long as your account is active and for 5 years after account closure.
Reviews: retained indefinitely as they form part of the public record of the Platform. If you request deletion, your review will be anonymised (name removed) rather than deleted.
Technical logs: retained for up to 12 months.
8. Cookies
Our Platform uses cookies and similar technologies for the following purposes:
Essential cookies: login session management, shopping cart functionality, and security tokens. These are necessary for the Platform to function and cannot be disabled.
Functional cookies: remembering your search preferences, language settings, and wallet toggle state.
Analytics cookies: we may use third-party analytics tools (e.g. Google Analytics) to understand how visitors use the Platform. These cookies collect anonymised data about page visits and user flows.
You can manage cookie preferences through your browser settings. Disabling essential cookies may prevent the Platform from functioning correctly.
9. Your Rights
Under the GDPR, you have the following rights regarding your personal data:
Right of access: you may request a copy of all personal data we hold about you.
Right to rectification: you may update your profile information at any time from your customer dashboard, or contact us to correct inaccurate data.
Right to erasure: you may request that we delete your account and personal data, subject to legal retention requirements.
Right to restrict processing: you may request that we limit how we use your data in certain circumstances.
Right to data portability: you may request your data in a structured, machine-readable format.
Right to object: you may object to processing based on legitimate interest at any time.

10. Data Security
We implement appropriate technical and organisational measures to protect your personal data, including: encrypted connections (HTTPS/TLS) for all data transmission, hashed password storage, role-based access controls for Lot Operators and staff, and regular security updates.
While we take reasonable precautions, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security of your data.
11. International Transfers
Your data is primarily stored on servers within the European Union. Where data is transferred outside the EU (e.g. through third-party services like Stripe), we ensure appropriate safeguards are in place, including Standard Contractual Clauses or adequacy decisions.
12. Children
Our Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal data from children. If we discover that we have inadvertently collected data from a minor, we will delete it promptly.
13. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes, we will notify registered users by email.
